|   सार्वजनिक जीवन में पारदर्शिता को अब तो कानून और तकनीक का भी सहारा मिल रहा है। फिर भी न्यायपालिका की इस बहस से दूरी बहुतों को खटक रही है। सूचना का अधिकार, न्यायाधीशों के लिए संपत्ति की घोषणा और जजों को अभिव्यक्ति की स्वतंत्रता जैसे पारदर्शिता के नए मुद्दों से दोस्ती में न्यायपालिका को वक्त लग रहा है।
सूचना के अधिकार से पहला झटका न्यायपालिका को ही लगा है। केंद्रीय सूचना आयोग का आदेश था कि मुख्य न्यायाधीश अन्य जजों की संपत्ति का ब्योरा सार्वजनिक करें। सुप्रीम कोर्ट को यह आदेश हजम नहीं हुआ। उसका मानना था कि चीफ जस्टिस का कार्यालय सूचना कानून से बाहर है। मामले को रजिस्ट्रार के जरिए हाईकोर्ट में चुनौती दी गयी। दलीलें चलीं आखिर में हाईकोर्ट ने फैसला सुना दिया कि भारत के मुख्य न्यायाधीश के दफ्तर पर सूचना कानून लागू होता है। फैसले के खिलाफ सुप्रीम कोर्ट ने अपने यहां ही अपील की है। सुप्रीम कोर्ट के पास सूचना के अधिकार से बाहर रहने के तर्क भले ही हों, लेकिन पारदर्शिता के दबावों की अनदेखी नहीं हो सकी। सुप्रीम कोर्ट के न्यायाधीशों ने स्वेच्छा से वेबसाइट पर अपनी संपत्ति घोषित करने का फैसला लिया। कई उच्च न्यायालयों के न्यायाधीशों ने भी ऐसा ही किया, लेकिन यह पारदर्शिता आधी है क्योंकि संपत्ति की घोषणा स्वैच्छिक है। इसके पीछे कोई कानूनी बाध्यता नहीं है और संपत्ति घोषणा का प्रारूप भी तय नहीं है।
संपत्ति घोषणा के पूरे विवाद की पृष्ठभूमि में भी पारदर्शिता ही है। यह बहस न्यायाधीश (संपत्तियां व दायित्व) विधेयक 2009 से शुरू हुई थी। इसकी धारा छह विवादित थी क्योंकि संपत्तियों की घोषणा पर जजों से सवाल जवाब का प्रावधान नहीं था। संपत्ति का खुलासा भी विशेष परिस्थितियों में संभव था। इसलिए कानून पारित नहीं हुआ और बहस जारी है।
न्यायाधीशों को अभिव्यक्ति की आजादी की बहस भी अब गरम है। कर्नाटक हाईकोर्ट के एक न्यायाधीश ने ब्लॉग पर अपने ही मुख्य न्यायाधीश के आचरण पर टिप्पणियां की। तो न्यायपालिका ने ब्लॉगर जज को आचरण की सीमाएं याद दिला दी। यानी जजों को न तो सार्वजनिक कार्यक्रमों में हिस्सा लेना चाहिए, न लेख लिखने चाहिए और न ही ब्लॉग। जजों को सिर्फ अपने फैसलों के जरिए ही बोलना चाहिए। वैसे अदालतों में पारदर्शिता पर सरकार भी असमंजस में ही दिखती है। कानून मंत्री वीरप्पा मोइली कहते हैं कि अदालत के कुछ हिस्सों को छोड़कर बाकी कामकाज में तो पारदर्शिता होनी ही चाहिए।

My husband was an employee of Electricity Department who had died in an accident while returning from duty. At that time he was a `Work-Charge’ employee. He was enlisted on 12.08.1974 and expired on 11.08.1985 in a Road accident. But the department has not granted any pension so far despite the fact that I have won the case from District court as well as from the Punjab and Haryana High Court, Chandigarh. These courts have also ordered to grant me the required Pension. But the Department instead of releasing me the pension has referred the case to the Hon’ble Supreme Court of India. I could not afford the heavy fees of the Supreme Court Advocates because I had become a penniless while conducting the cases in lower court and the High Court. I have only two daughters and I have met the expenses of their education and their marriage by taking loan on heavy interest because my husband had no agriculture land. He was entirety dependent on his service, which also was snatched by the hands of cruel death. Therefore being already under heavy debt I could not afford the heavy fees of the highest court and that is why I could not contest the case in the Hon’ble Supreme Court. In this way ex-party decision was given against my interests.
I may mention here that many widows like myself have been taking the benefits of Pension and other financial benefits till today under competence of lower as well as High Court. Is this a fault of mine that I am a poor Widow? Whereas the whole country is celebrating `Women day’ and fighting for the rights of the Women in distress why such cruelty and injustice is being done with me? The women are not legging behind in any sphere like State Assemblies and Lok Sabha but why I am being given a step – motherly treatment.
Hon’ble President I am very happy that your majesty is also a woman and that a woman can only understand the agony of a Widow Woman. How these 26 years have I passed being a poor widow and setting my two daughters can be understood. I not only hope but have a full faith that you would be kind enough to imagine my pity condition and order the concerned officers of the Electricity Department of Haryana to give me the Pensioner benefits so that justice should not be denied to me which has, however, been much delayed.
